LEGAL NOTICE
1. GENERAL TERMS AND CONDITIONS
The General Terms and Conditions are an integral part of the contract concluded between Gaja Pavliha s.p. and (hereinafter Wild life Slovenia) and the client who pays and registers for a service organized by Wild life Slovenia. In the event that an individual provision in the program is regulated differently than in these general terms and conditions, the provisions stated in the program shall apply.
In the case of telephone sales or sales via the Internet, it is deemed that the client has accepted the provisions of these general terms and conditions when he ordered the service by telephone or via the Internet. The client can familiarize himself with the provisions of the general terms and conditions on the website http://www.wildlifeslovenia.com, where they are specially marked and generally accessible.
The client or client is any person who has made a valid reservation or paid for services.
These general terms and conditions do not apply to the rental of cars and taxis and other equipment of service providers, where Wild life Slovenia is represented as an intermediary. In this case, the client is bound by the general terms and conditions of the providers and the legislation in this area.
1. APPLICATION AND CONTRACT
The client can apply for services in the Wild life Slovenia organization at www.wildlifeslovenia.com. The service program is considered an offer. Based on the offer, the client applies for the selected service by paying. Upon application, the client receives a wildlifeslovenia.com document (invoice, which is a service contract), which shows all the information about the ordered service. The client is obliged to review the document and, in the event of any disagreement or error, complain about it within one day after its issuance. The contract is considered concluded upon payment. The client is obliged to provide the required information when applying and submit the documents required by the service program and make the payment in accordance with the provisions of these general terms and conditions. If the client does not provide correct information when applying, he is responsible for all costs or consequences resulting from incorrect information.
The client’s application is binding. He may withdraw from it in accordance with the provisions on the cancellation of the client’s services. In the event of cancellation of services by the client/guest, the client is obliged to pay all costs in accordance with the provisions on cancellation of services by the client/guest.
Wildlifeslovenia.com is obliged under the contract to provide the client with services that have the content and characteristics as announced in the contract or service program and to take care of the rights and interests of the client/guest in accordance with good business practices.
III. REGISTRATION FEE AND DEPOSIT
Wild life Slovenia charges the client a standard 100% reservation fee for its services. Wild life Slovenia may set different reservation fees for individual services.
1. PAYMENT
The day of payment is considered the day when the client makes a payment directly to Wild life Slovenia, or when Wild life Slovenia receives payment to the transaction account. The client or group pays 100% of the gross price of the offer upon registration, unless otherwise specified in the offer. Timely payment means a confirmed reservation. If the client does not pay within the agreed deadline, this means cancellation of services and the provisions on cancellation of services by the client/guest apply mutatis mutandis.
The client undertakes to pay the difference that may arise due to a possible calculation error on the issued document by Wild life Slovenia, and Wild life Slovenia undertakes to refund the client/guest any overcharged amount resulting from the calculation error. This obligation is valid until the end of the financial year.
Wild life Slovenia may stipulate in the program that the client pays for certain services that will be performed on site to its representative (“mandatory surcharge on site”). In this case, Wild life Slovenia does not act as an organizer or an intermediary, but only as an informant. In this case, the client asserts all claims for complaints exclusively from the service provider on site.
1. PRICES
The prices of services are determined by the program and are valid from the date of publication of the program until changed. The price includes the services listed in the service program. For client a, the price on the day of conclusion of the contract/issuance of the invoice is valid.
In accordance with applicable law, Wild life Slovenia may change this price even after the conclusion of the contract, due to changes in the exchange rate or due to changes in the tariffs of carriers that affect the price of the services. In the event of a price change in this regard, Wild life Slovenia shall notify the client/guest in writing no later than 2 days before departure and shall issue an additional document (invoice), which the client is obliged to pay before the start of the services.
If the increase in the agreed price exceeds 8 percent of the price of the services, the consumer may withdraw from the contract without having to compensate for the damage. In this case, Wild life Slovenia will return the amount paid to the client.
Wild life Slovenia also sets a starting price in the service program for a certain number of clients, which may change if a smaller number of clients apply for the service. Wild life Slovenia shall indicate this additional price in the program in the form of a “mandatory surcharge in the case of a group size of from/to persons”. When registering Wild life Slovenia.
The client charges the guest the starting price of the services. If the conditions for changing the price due to “smaller groups” occur, the client cannot withdraw from the contract, as they were informed of them upon registration.
1. SPECIAL SERVICES
Special services are those services that are generally not included in the price of the services (special meals, other optional extras, etc.) or for which additional charges are foreseen in the program (other additional charges, etc.), therefore the client pays for them separately, unless otherwise specified in the program.
In the event that special services are offered for an individual service, the client submits the wishes for these services upon registration, and pays them in addition to the price. The published prices for special services are valid only in the event of ordering and paying for these services upon registration for the service. During the service, the client pays for special services to the guide or Wild Life Slovenia representative in the place where the service is performed, if it is still possible to order them during the service, at the price valid on the spot.
VII. SUBSCRIBER’S AMENDMENT OF THE CONTRACT OR CANCELLATION OF SERVICES
The subscriber has the right to request a change to the contract (e.g. change of name, additional services, etc.) after its conclusion, and Wild life Slovenia is obliged to check whether this is even possible. In the event of a change to the contract at the request of the subscriber Niko Špik, the subscriber may charge the subscriber administrative costs in the amount of EUR 30.00 for the change, unless otherwise specified in these general terms and conditions. In the event that the change results in additional costs, the subscriber is obliged to pay them.
The subscriber has the right to cancel the services directly with Wild life Slovenia. In the event that the subscriber cancels the service, Wild life Slovenia is entitled to a refund of the costs, which depend on the time remaining until the start of the service.
In any case, Wild life Slovenia charges the subscriber an advance payment of EUR 30.00. Unless otherwise specified in the program, the following cancellation fees apply:
For one-day services:
• cancellation up to 30 days before the start of the service, 10% of the price,
• cancellation from 29 to 22 days before the start of the service, 20% of the price,
• cancellation 21 to 15 days before the start of the service, 30% of the price,
• cancellation 14 to 8 days before the start of the service, 50% of the price,
• cancellation 7 days to the start of the service, 100% of the price,
Regardless of the above-specified cancellation fees, they may be different when dictated by the conditions of organizing the services, i.e. which are dictated by Wild life Slovenia’s valid terms of sale and/or conditioned by business partners.
Regardless of the above-specified fees, cancellation fees may also be different if they are stated in the service program or contract.
When canceling the services before departure, the client submits a written cancellation via Wild life Slovenia’s email. If the client refuses to sign or confirm this document, it is considered that the service has not been canceled. During the service, the client may terminate the service at his/her own request. If the client terminates the service, he/she is not entitled to a refund of costs or purchase price, either partially or in full, upon return. If the client changes the program during the service at his/her own request, which is an integral part of the contract with Wild life Slovenia, it is considered that the client has withdrawn from the contract during the service. In this case, the client is liable for the costs and damages caused by this. In the event of a change in the program at his/her own request or due to force majeure, without there being any reasons on the part of Wild life Slovenia due to improperly performed service, the client is not entitled to claim any compensation or price reduction.
Wild life Slovenia or an authorized person may at any time before the service or on the day of departure refuse a person if it assesses that the client could endanger the health or property of himself/herself or others, or who is clearly under the influence of alcohol, drugs or other such substances upon departure. In this case, Wild life Slovenia will act in accordance with the provisions on the cancellation of the client.
Wild life Slovenia has the right to request the client-guest to terminate the service with the group during the service if he does not ensure that he personally, his personal documents and his luggage meet the conditions prescribed by border, customs, sanitary, monetary and other regulations, or if he is clearly under the influence of alcohol, drugs or other such substances or if he behaves inappropriately towards others and his exclusion is requested by the group. In this case, Wild life Slovenia will act in accordance with the provisions on the cancellation of the client.
Wild life Slovenia will enforce all damage caused by his inappropriate behavior during the duration of the service.
The amount of the costs of canceling the service in the event that Wild life Slovenia is not the organizer of the service is determined by the general terms and conditions or another act of the organizer.
VIII. CHANGE OF PROGRAM OR CANCELLATION OF THE SERVICE BY THE ORGANIZER
In accordance with applicable legislation, Wild life Slovenia reserves the right to cancel the service if the minimum required number of participants specified in the service program does not register for the service.
Wild life Slovenia will notify the client of the termination of the contract if the minimum number of participants has not registered, no later than: – 6 hours before the start of the services to be provided.
In cases where Wild life Slovenia explicitly guarantees the implementation in writing, it cannot cancel the service, unless fewer than the minimum number of participants in the service specified in the program register.
Wild life Slovenia reserves the right to fully or partially withdraw from the contract if extraordinary circumstances arise before or during the implementation of the program that could not have been expected, removed or avoided, and for Wild life Slovenia these circumstances constitute a valid reason for not concluding the contract if they existed at the time of concluding the contract.
Wild life Slovenia may cancel the contract or withdraw from the contract and demand compensation for damages from the client who directly violates the provisions of the contract concluded with Wild life Slovenia, especially if it is found that the client intentionally provided incorrect information about the number of participants or their age, or if changes occurred during the service and the client did not inform Wild life Slovenia of this. Wild life Slovenia reserves the right (and is not liable) for changes to the date and time of departure or for cancellations of the service due to force majeure, and the right to change the service if the conditions for the service change (new timetable, uncertain situation in the country where the service is organized, natural disasters or other unforeseen causes that Wild life Slovenia cannot influence), without special compensation and in accordance with applicable passenger transport regulations.
Wild life Slovenia’s liability is limited only to the failure to carry out a certain part of the program, in the part that entails appropriate material costs. Wild life Slovenia is not liable for non-material damage that would arise from delays, cancellations or changes to transportation or means of transport.
Wild life Slovenia can not assume liability for changes to the program due to any force majeure during the program. In these cases, it may provide the client with services in a modified form, based on existing possibilities.
In the event that Wild life Slovenia cancels the service, the client has the right to a full refund of the paid price, but is not entitled to a refund of the costs that were required by the program. Wild life Slovenia will inform the client immediately of any subsequent changes to the program.
1. TRAVEL DOCUMENTS
The client must have a valid passport or other valid document with. Wild life Slovenia is not responsible for any inconvenience or forced termination of services for service participants in this regard.
The client is obliged to obtain visas that are required for the country. If the client fails to fulfill this obligation, Wild life Slovenia will act in accordance with the provisions on cancellation of services on the client’s part. In the event of refusal of entry into the country or other obstacles, the client bears all costs himself.
Due to the requirements of passenger transport, the client is obliged to provide all necessary information about all participants he/she registers upon registration. The information must fully match the information in the official documents that the participants of the services are carrying with them in accordance with the regulations on crossing the state border and relevant foreign legislative acts. In the event that incorrect information causes a delay, additional costs or interruption of services to other participants, the client is responsible for all costs incurred by the participants.
If the client loses documents during the service or they are stolen, but they are absolutely necessary for the continuation of the service or for returning to their homeland, the client must obtain new ones at his/her own expense. In the event that the client has to interrupt the service due to the loss or theft of documents, he/she is not entitled to any refund of the paid price of the services or reimbursement of costs.
1. HEALTH REGULATIONS
Wild life Slovenia is not responsible for any complications or interruption of services by the client due to non-compliance with the health regulations of the country they enter, nor for the costs associated with this.
1. CUSTOMS AND FOREIGN EXCHANGE REGULATIONS
The client is obliged to comply with all customs and foreign exchange regulations of the Republic of Slovenia, as well as the regulations of all other countries of service. If the client is unable to continue due to non-compliance with the regulations, he/she shall bear all consequences and costs arising in this regard for him/her and all other participants in the service.
XII. LUGGAGE
Wild life Slovenia is not responsible for the transport, theft or damage to the participants’ luggage or other personal belongings, valuables and documents of the means of transport.
XIII. INFORMATION
The information received by the client does not bind Wild life Slovenia more than the statements in the program or offer. In case of doubt, a written offer, invoice and contract, written information or written explanation is always considered valid.
XIV. COMPLAINTS OR COMPLAINTS
The client is obliged to report irregularities to the Wild life Slovenia representative on site when they occur. In the event that the complaint could be resolved on site (for example, a poorly prepared dish), but the client did not report
errors or irregularities to a representative of Wild life Slovenia, it is considered that the client has agreed to such a service and has thus lost the right to file subsequent complaints. The client may file a written complaint within one month from the date on which the service was performed incorrectly, otherwise Wild life Slovenia will not consider it in terms of content. The complaint must be substantiated. The client should therefore attach appropriate evidence and/or appropriate confirmation from the client, caterer, carrier or other appropriate person about the actual situation on the basis of which the client is asserting his claim.
Wild life Slovenia is obliged to respond to the complaint in writing within 8 days of its receipt. If it is a simple deficiency and the error is not disputed (or if the client did not attach all the necessary documents within the time limit required to obtain them), Wild life Slovenia is obliged to grant the request after receiving a complete complaint request. If the error is not simple, Wild life Slovenia is obliged to investigate all the circumstances that led to the complaint. Until Wild life Slovenia decides on the complaint, the client waives the right to intervene with any other person, judicial institutions or provide information to the public media.
The amount of compensation is limited to the amount of the price paid for the service or the amount of the real value of the services not performed. This provision does not apply in the event that Wild life Slovenia has the right to cancel the services or change the program, in accordance with the provisions of these general terms and conditions and the law.
Regardless of the complaint filed, the client is obliged to settle its obligations under the issued invoices for the service provided in accordance with the payment schedule, and any compensation is paid after the complaint procedure is completed to the personal account of the client / guest.
XVI. USE OF DATA
Wild life Slovenia protects all obtained data about clients in accordance with the Personal Data Protection Act. Wild life Slovenia processes all obtained data about clients in accordance with the Personal Data Protection Policy, available at www.wildlifeslovenia.com.
XVII. RESPONSIBILITY
By paying the Wild Life Slovenia service invoice, the client:
– accepts the terms of personal data protection
– accepts responsibility for the participants in the service and their property
– does not hide health problems that could prevent the participants from participating in the service
– in the event that problems arise, they will only report them to the representative
– is aware of the responsibility and possible consequences of participating in the services
Wild Life Slovenia and other persons cooperating with the company are in no way liable for: bodily injury, damage to the individual’s equipment and property, damage to borrowed equipment and own equipment for the implementation of the excursion/activity, vehicles, other damage during the service…
XVIII. FINAL PROVISIONS
In the event of a dispute between the parties, the competent court shall apply.
